Platform terms for managers, workers and branch owners using ShiftCover365.
1. Introduction
These Terms & Conditions govern use of ShiftCover365. By accessing or using the platform, you agree to these terms.
2. Platform Purpose
ShiftCover365 provides tools for shift cover management, worker applications, operational visibility, accountability indicators, shift audit trails and till-check workflows for shift-based businesses.
3. Operational Status
ShiftCover365 is in active commercial use. Features may be updated, added, paused or removed as the platform develops. Significant changes will be reflected in the effective dates on these legal pages.
4. User Accounts
Users must provide accurate information, keep login details secure, promptly update incorrect details and not share access with unauthorised people. We may suspend accounts where we reasonably suspect misuse, fraud, security risk or breach of these terms.
5. Manager Responsibilities
Managers and branch owners are responsible for checking worker suitability, confirming branch requirements, complying with employment, tax, health and safety, right-to-work and workplace obligations, and making fair decisions based on appropriate information. ShiftCover365 does not act as an employer, employment agency, or right-to-work checker.
6. Worker Responsibilities
Workers are responsible for providing accurate profile information, only applying for suitable shifts, attending approved shifts, following branch procedures, completing required check-ins honestly and communicating promptly about cancellations or issues.
7. Worker Classification
Workers using ShiftCover365 are independent contractors and are not employees, workers (in the statutory sense), agents or representatives of ShiftCover365. ShiftCover365 acts solely as a technology platform that connects branches with available workers and provides accountability tooling — it is not an employer, an employment agency, an employment business, a staffing agency, or a payroll provider.
Each engagement between a branch (or manager) and a worker is a direct arrangement between those parties. The branch and worker are responsible for agreeing pay, tax status, IR35 considerations where applicable, insurance, right-to-work checks, health-and-safety obligations and any other employment-law requirements. ShiftCover365 does not pay workers, does not deduct tax or National Insurance, and does not assume any employer liability.
8. ShiftSecure and Accountability Features
ShiftSecure (our accountability suite) may include reliability indicators, ratings, reviews, cancellation history, Smart ID status, shift history and audit trails. ShiftCover365 does not perform formal identity-document checks, background checks, criminal-record checks or right-to-work verification. Smart ID status is either self-declared by the worker or confirmed by a manager inside the app. These tools support decision-making but do not replace fair human review or legal compliance.
8. Till Accountability
Till check and discrepancy features are designed to record operational events and support investigation. They must not be used unfairly or as automatic proof of misconduct or liability without proper review and evidence.
10. Payments and Fees
Where payments, subscriptions, pay-as-you-go fees, penalties or add-ons apply, additional pricing and payment terms apply. Card payments are processed by Stripe; ShiftCover365 stores only a Stripe customer reference and saved payment-method identifier — not your card details. Users will be informed of applicable fees before being charged.
11. Acceptable Use
Users must not misuse the platform, submit false information, harass others, bypass security, scrape data, upload malicious content, impersonate another person, interfere with the service or use data for unauthorised purposes.
12. Data Protection
Users must handle any personal data accessed through ShiftCover365 fairly, securely and only for legitimate platform-related purposes. Managers must not export, share or misuse worker data outside appropriate operational needs.
13. Availability and Changes
We aim to provide reliable access but do not guarantee uninterrupted service. ShiftCover365 does not currently hold formal availability or compliance certifications (such as ISO 27001, SOC 2 or a published uptime SLA). Features may be updated, paused, removed or changed as the platform develops.
14. Intellectual Property
The platform, branding, software, designs, content, processes and the ShiftSecure name are owned by or licensed to ShiftCover365. Users may not copy, reproduce or exploit them without permission.
15. Limitation of Liability
To the fullest extent permitted by law, ShiftCover365 is not responsible for indirect losses, business interruption, employment disputes, worker conduct, manager decisions, branch losses or outcomes resulting from user misuse. Nothing excludes liability that cannot be excluded under law.
16. Account Termination and Deletion
Users may delete their account from inside the app or by submitting a request at /account-deletion when signed out. Deletion has two phases: (1) immediate deactivation — you are signed out and the account can no longer be used; and (2) an automatically-created GDPR erasure request that our team reviews and actions within one month, in line with UK GDPR Article 17. Approved erasure removes your personal data across user profile, shifts, ratings, chat messages, till logs and most accountability records. Payment transactions are retained for 7 years to satisfy HMRC tax record-keeping obligations, and a small set of audit-log rows (deletion records, policy-acceptance records, admin-action logs) is retained indefinitely so we can demonstrate compliance with UK GDPR itself. 17. Governing Law
These terms are governed by the laws of England and Wales. Disputes will be subject to the courts of England and Wales unless mandatory law provides otherwise.
